Partition actions generally fall into three categories:

  • Partition in Kind
    The property is physically divided among the owners. This works best with land or properties that can be split without losing value or functionality.

  • Partition by Sale
    When physical division isn’t practical—think single-family homes, condos, or smaller lots—a court may order the property to be sold, with the proceeds split among the co-owners.

  • Partition by Appraisal
    Sometimes, one party wants to keep the property and is willing to buy out the others. In those cases, an accurate, independent appraisal is essential to ensure fairness.
